Welcome to Novilla.By opting into the Novilla Text Message Program (the "Program"), you agree to these SMS/Text Message Terms and Conditions ("SMS Terms and Conditions").

1. Program Description & Opt-In

By opting in, you agree to receive recurring automated promotional, transactional, and personalized marketing SMS messages from Novilla  ("we," "us," or "our") regarding our products or services. 

You may opt in by submitting your mobile number through our online pop-up forms, checkout pages, or by texting a designated keyword. Consent is not a condition of any purchase.

2. Message Frequency

Message frequency may vary. You may receive up to 4-8 messages per month. We strive to keep message volume reasonable to avoid disrupting your experience. Transactional messages (including order confirmations, shipping updates, and account security alerts) are not considered marketing messages and are not subject to the above frequency limits, as they are essential for fulfilling your contractual rights and ensuring account security.

3. Cost & Carrier Charges

Message and data rates may apply. Please contact your wireless carrier for details about your mobile plan and pricing. Novilla is not responsible for any charges or fees incurred from your mobile service provider resulting from SMS/MMS messages. By subscribing, you acknowledge that you are responsible for any costs incurred by your carrier for receiving these messages.

4. Opt-Out (Unsubscribe)

If you wish to stop receiving text messages from Novilla, you can opt out of the Program at any time. Text or reply STOP to any message you receive from us. You will receive an automated one-time confirmation text confirming your unsubscribe request. After opting out, you will no longer receive marketing messages from us unless you re-enroll.

6. Privacy Policy

You information collected through the Program will be processed in accordance with applicable laws and our Privacy Policy. Novilla does not sell, rent, or share your mobile opt-in data or text messaging consent with third parties for their marketing purposes.

7. Intellectual Property

All content provided via SMS is protected by intellectual property laws and may not be reproduced without permission. All content, materials, text, graphics, logos, and promotions provided via the Program are protected by applicable intellectual property laws and remain the property of Novilla.

8. Limitations of Liability

Novilla is not liable for any delays, delivery failures, or damages, including but not limited to losses arising from use of the SMS service.

9. Governing Law& Dispute Resolution

This agreement shall be governed and construed in accordance with applicable laws without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to the Program or these SMS Terms shall be resolved in connection with the main Terms of Service of https://www.novillashop.com/.

10. Modifications to Terms

We reserve the right to modify or terminate the Program or these SMS Terms at any time. Any changes will become effective immediately upon being posted on our website. Your continued participation in the Program following such changes constitutes your acceptance of the revised terms.
